1. Who we are
Spanish Rental Contract is a service of PropertyHost. When buying at a distance within the EU you are entitled to know who you are dealing with; our details are set out below.

2. What you are buying — and what you are not
We supply model contracts for letting a home in Spain, drawn up on the basis of Ley 29/1994 (Ley de Arrendamientos Urbanos) and the relevant regional rules, and completed with the details you enter yourself. You receive the document bilingually, in Spanish and English, with the Spanish text being the version that binds the parties.
What you are not buying:
- Legal advice. We do not assess your personal situation and do not act as a lawyer, gestoría or tax adviser.
- A guarantee that the contract will hold up in a specific dispute. That depends on facts and conduct outside our view, including whether the temporary nature of a seasonal let can genuinely be evidenced.
- Tax filings, or the handling of registrations and licences on your behalf.
- A tourist letting licence. Letting for holiday or leisure purposes falls outside the LAU and is regulated regionally; no model contract can help with that.
The result of the free contract check is an indication based on your own answers. Give different answers and the result changes. The check is no substitute for having your situation assessed by a professional.
3. Prices, delivery and withdrawal
Prices are stated on the website and are inclusive of VAT. You pay once; there is no subscription and nothing renews automatically.
The document is delivered digitally, immediately after payment. For digital content supplied immediately, the following applies: at the point of purchase you give your express consent to immediate supply and acknowledge that you thereby lose your statutory fourteen-day right of withdrawal (Directive 2011/83/EU). Without that consent, we deliver only after fourteen days.
If something does not work, or the document contains an error caused by us, we will put it right or refund you. That stands apart from the right of withdrawal.
Corrections
For up to thirty days after purchase we will amend your own details free of charge where you have entered a name, date, amount or address incorrectly, and deliver the document afresh.
Revisions when the law changes
For up to twelve months after purchase you receive, free of charge, a revised version of your model contract whenever a change in the law affects the model. We notify you by e-mail at the address you used at checkout. This is an obligation to supply an updated model; it is not an obligation to amend the contract you have already signed with your tenant, and it is not advice on what a change means for your existing tenancy.
4. Liability
We make every effort to keep the models current and correct, and base them on the published statutory texts and the regional regulations. Even so: you use the document at your own responsibility, and the outcome of a tenancy or of proceedings depends on circumstances we do not know and cannot influence.
Our liability is limited to the amount you paid for the product concerned. We are not liable for consequential loss, including lost rental income, the costs of proceedings, fines imposed by a public authority, or loss arising from failing to lodge the deposit (fianza) or lodging it late. This limitation does not apply in cases of intent or gross negligence on our part, nor to the extent that mandatory consumer law precludes it.
If there is an ongoing dispute, an unusual arrangement or a large financial interest at stake: have the contract reviewed by a lawyer admitted to practise in Spain. That costs a fraction of what a failed eviction costs.
5. Privacy
Which data, and what for
- Your answers to the contract check. We process these in your browser to determine the result. If you request the checklist by e-mail, we send your answers along with your e-mail address, so the checklist matches your situation.
- Your e-mail address, if you request the checklist or buy something. Legal basis: performance of the contract, or your consent in the case of the checklist request. We use it to send you the checklist, your document and revisions when the law changes.
- The details you enter for the contract: names, identification numbers, the address of the property, the rent and the term. We use these solely to draw up the document.
- A processing record for each purchase: which model version and which clauses were used, and which answers they were based on. This is necessary to supply you with a correct revision later, and to establish exactly what we delivered.
Retention period
We retain contract data and the processing record for seven years, for as long as required by our tax retention obligations and to be able to demonstrate what was delivered. An e-mail address held only for the checklist is kept for two years, or less if you unsubscribe.
Recipients
We do not sell your data and do not use it for advertising profiles. We engage service providers for payment (Stripe), e-mail delivery and hosting/security (Cloudflare); they process solely on our instructions. When you pay, you do so on a Stripe payment page; Stripe's privacy policy also applies there.
Your rights
You have the right of access, rectification, erasure, restriction, objection and data portability, and you may withdraw your consent at any time. Send a message to info@propertyhost.app. If you are not satisfied with how we handle it, you can complain to the competent supervisory authority.
Cookies and statistics
This website places no tracking or advertising cookies and therefore does not ask for cookie consent for those. The contract check runs entirely in your browser; your draft answers are stored locally by your browser (localStorage) and never leave your device, except when you generate a document or request the checklist yourself.
For visitor statistics we use Google Analytics, only with your consent. By default measurement is off (Consent Mode, "consent denied"): no analytics cookies are placed and no device identifiers are stored. Only when you click That's fine in the cookie notice do we place one statistics cookie with which Google Analytics measures visits. We use that data solely to see which pages help — not for advertising, and it is never resold. We remember your choice in your browser for twelve months and you can revisit it at any time via the Cookie preferences link at the bottom of every page. In addition, we see aggregated, cookieless traffic statistics from our hosting provider Cloudflare (no consent is needed for that; nothing is placed on your device), and we use Google Search Console — which only measures how our site appears in search results.
6. Governing law
The model contracts are drawn up under Spanish law and assume Spanish jurisdiction; for the letting of property located in Spain, that is not something the parties are free to contract out of. The agreement between you and us for the purchase of the document is governed by Spanish law, while the mandatory consumer protection of your own country of residence continues to apply.
